The Marihuana Tax Act of 1937 was created by infamous anti-cannabis activist Harry Anslinger, and signed into law on August 2, 1937. Until this law was passed, all cannabis products were legal to sell in pharmacies, as long as they were properly labelled.
This was one of the first times that the US government actually acknowledged “marihuana.” (the name marihuana was derived from Mexican Spanish). The word was made popular by Harry Anslinger as part of his campaign to create fear of the drug (which is kinda funny when you think about it now). Before all of this, the drug was more commonly referred to as “hemp” or “cannabis sativa,” and was even considered almost fashionable.
The first person to actually be arrested under the Marihuana Tax Act of 1937 was the one person Harry Anslinger was trying to catch out with his act – a Mexican-American called Moses Baca, who had a quarter-ounce of cannabis in his drawer. Ouch!
